These activities may require a Fish Habitat Permit. Construction of a dam or an impoundment in fish bearing waters require a Fish Habitat Permit. These structures are often required for placer or hard rock mining operations, flood control, and hydroelectric power generation. These structures commonly contain freshwater but may also be used to contain mine tailings. Fishways may or may not be required to be built in conjuction with the structure. This determination is assessed on a case-by-case basis, as is based upon the type and number of fish present and the extent of fish habitat that may be significantly affected by the project. Dams may also be regulated by the Alaska Department of Natural Resources Dam Safety and Construction Unit. Dams that are regulated under the Dam Safety Program are those that (a) impound 50 acre-feet or more and are 10 feet high; (b) are 20 feet high; or (c) would threaten lives and property if they failed. The state statutes do not apply to federally owned or operated dams or hydroelectric dams regulated by the Federal Energy Regulatory Commission.
